1. Acceptance of Terms

By accessing or using PDFSense, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

2. Account Registration and Security

You must register for an account using Clerk to access our dashboard, upload documents, and start chat sessions. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Document Uploads and Content Rules

When uploading PDF documents to PDFSense:

  • You represent and warrant that you own or have the necessary intellectual property rights and permissions to upload and process the documents.
  • You agree not to upload any content that is illegal, defamatory, harmful, contains malware, or violates any third-party privacy or intellectual property rights.
  • We reserve the right to remove any documents that violate these terms or disrupt the operation of our systems.

4. Service Limitations and Quotas

PDFSense enforces quotas based on your subscription tier:

  • Free Plan: Limited to a total of 3 documents (active or deleted), maximum 10MB per file, and up to 30 messages in total.
  • Pro Plan: Limited to 25 documents, maximum 20MB per file, and up to 500 messages per month.

Attempts to circumvent these quotas (including creating multiple accounts or manipulating client-side properties) are strictly prohibited and may result in permanent termination of your account.

5. Generative AI Disclaimer

PDFSense provides AI-grounded summaries and chat responses based on document content using Retrieval-Augmented Generation (RAG). While we strive for accuracy, generative AI models can occasionally produce incorrect information or "hallucinations."

The service is provided on an "as-is" and "as-available" basis. PDFSense makes no warranties, express or implied, regarding the correctness, reliability, or completeness of the responses generated by the AI assistant.

6. Limitation of Liability

To the maximum extent permitted by law, PDFSense and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, goodwill, or other intangible losses resulting from the use or inability to use the service.

7. Account Suspension and Termination

We reserve the right, at our sole discretion, to suspend or terminate your account and restrict your access to PDFSense at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users, our business partners, or the public.

8. Governing Law

These terms shall be governed by and construed in accordance with the laws of your local jurisdiction, without regard to its conflict of law principles.
